Most people who make a claim have been injured in a road traffic accident. As well as being a driver you may have been a pedestrian, a cyclist or a passenger in a vehicle who, through no fault of your own, has been injured. You are entitled to receive compensation usually paid by the driver’s insurance company. If there is no insurance in place your claim may be dealt with by the Motor Insurers’ Bureau (MIB). In the event of a ‘hit and run’ accident, a claim can be brought against an untraced driver via the MIB too. In any of these circumstances the team at CA Solicitors want to help decrease the stress of bringing a claim and to make the process as swift and straightforward as possible.
What to do in the event of a road traffic accident
Obviously this is going to be a stressful time for everybody involved but you need to ensure that you remain calm and do not become angry with the person who you feel caused the accident. Call the police and remain at the scene until the police arrive as they will want to ask you and the other party some questions and take details. Take as much witness information as you can if you are able. The police will get this information and we can obtain it from them, but to avoid delays take as much information as you can yourself. Names, addresses and vehicle registration are good pieces of information to take down.
If you are able take photographs of the scene, although we appreciate you may not be in a position to do this if injured, nor will it be the first thing on your mind. Make a note of street names, the speed at which you were travelling and your estimate of the speed at which the other party was travelling, vehicle location and direction of travel, vehicle damage and collision points.
Take a note of the details of the other party’s vehicle to include registration number, vehicle type and colour. All drivers much exchange details by law. It’s handy too to make a note of weather conditions and whether the roads were dry , wet or icy.
The claim
In the first instance CA Solicitors will ask you to fill out a Road Traffic Accident Questionnaire in as much detail as you can and once it is returned/submitted will assess it to be able to fully advise you on all aspects of your case. CA Solicitors understand that taking the decision to proceed with a claim can be difficult for the individual so we aim to make it as simple and as stress-free for you as possible.
