Motorcycle Crash Victim Wins Damages

A man knocked off his motorbike by a car has won substantial compensation for his injuries. Gareth Llewellyn, 49, a Research Officer, was struck by the car in Swansea in 2003. The accident caused him multiple spinal injuries for which he required complex surgery. At one point, due to complications, he had to be transferred to the Intensive Care Unit. After leaving hospital he required a period of rehabilitation.

 

Mr Llewellyn brought the action against the driver of the car, who denied causing the accident. It was claimed that Mr Llewellyn had been speeding and had also cut across in front of the car. Evidence provided by the police disproved this defence however.

 

Before filing its defence of the claim, the insurance company made an offer of £50,000 to settle the case. This offer was rejected, as was a series of later offers, as being insufficient compensation for the serious injuries he had suffered.

 

Expert evidence was obtained from a number of sources. A consultant neurologist, an orthopaedic surgeon and an expert in rehabilitation were amongst those who provided reports of Mr Llewellyn’s condition and needs. He already requires help with day-to-day tasks and may in future need to have changes made to his home, such as the installation of a stair-lift.

 

As a result of his legal support, Mr Llewellyn was able to obtain compensation in excess of that initially offered by the insurance company.
