Compensation for Whiplash

Two drivers have won compensation for whiplash injuries sustained in separate accidents. Both drivers were stationary when the collisions occurred and both their vehicles were hit from behind. Each driver has received an undisclosed sum in compensation.

Kenneth Beaumont was stationary at a roundabout in Kent as he had stopped to give way to a bus. Unfortunately, a van owned by a construction company shunted into the rear of Mr Beaumont's car, causing him to sustain a whiplash injury to his shoulder and neck. A claim was successfully brought against the construction company's insurance provider.

In the other incident, a woman from the Wirrall was involved in an accident when she was stationary at a roundabout on the M53. Another car ran into her, causing a whiplash injury, again to the shoulder and neck. Whilst the driver of the other car initially admitted liability, she later defended the case in court. The defendant claimed she could not have caused so serious an injury as she was travelling at no more than 5 mph. Despite this, the victim of the accident won her case and was awarded compensation.
